Num diálogo entre a Teoria Constitucional e a Filosofia Jurídica, O Ponto de Arquimedes procura levantar eternas interrogações sobre a fundamentação e a legitimação do Direito. Num tempo de consenso aparente e por vezes hipócrita em torno dos Direitos Humanos, o desafio é o de saber quais as suas raízes- a simples vontade do poder, sempre reversível, ou o Direito Natural e a própria natureza do Homem? 1. Mitos, memórias, conceitos -- Direitos humanos, direitos fundamentais.

Repisando a trilha clássica de aproximação ao Direito, o livro repropõe o método realista para pensar o Direito. Um estar de novo do pensamento jurídico tradicional, com sua persistente atualidade, está a exigir que se retome e guarde a analogia do termo Direito e a conclusão de que, antes de mais, sendo o Direito uma coisa, a 'coisa justa', seus demais possíveis conceitos são somente analogados secundários que, por importantes se estimem, demandam sempre referência subalterna àquele prius significativo - antes (...) de tudo, o Direito é justo. Essa perspectiva realista reabre a esperança de que, mediando a experiência e a dialética, se reencontre e aprofunde uma teoria da justiça ancorada na natureza das coisas. Paulo Ferreira da Cunha e Ricardo Dip uniram aqui suas meditações acadêmicas para, comungando da doutrina jusnaturalista clássica formular um convite para que se pense realmente o Direito. (shrink)

For centuries, natural law was the main philosophical legal paradigm. Now, it is a wonder when a court of law invokes it. Arthur Kaufmann already underlined a modern general "horror iuris naturalis". We also know, with Winfried Hassemer, that the succession of legal paradigms is a matter of fashion. But why did natural law become outdated? Are there any remnants of it still alive today? This book analyses a number of prejudices and myths that have created a general misconception of (...) natural law. As Jean-Marc Trigeaud put it: there is a natural law that positivists invented. Not the real one(s). It seeks to understand not only the usual adversaries of natural law (like legalists, positivists and historicists) but also its further enemies, the inner enemies of natural law, such as internal aporias, political and ideological manipulations, etc. The book puts forward a reasoned and balanced examination of this treasure of western political and juridical though. And, if we look at it another way, natural law is by no means a loser in our times: because it lives in modern human rights. (shrink)

1. Do realismo clássico à análise mítica.

Le droit doit certainement avoir une âme. Mais il a aussi un corps. Dans le corps du droit - souvent méprisé, souvent ignoré -, les symboles, l'iconologie, mais aussi la relation du juridique avec les arts et l'esthétique, gagnent de nos jours de plus en plus d'importance. On redécouvre une relation entre le droit et les sens : le droit qui écoute les parties, le droit dit aveugle ou le droit bandé, le droit qui sent et pressent par l'odorat, le (...) droit qui touche, et même un droit qui dé-gôute... La présente contribution pour une philosophie symbolique du droit recueille des études sur les différents aspects de ce droit sensible et sensitif. (shrink)

Is the dream of EU endangered? This book reviews classic and modern values and virtues, and uses them in order to rethink Europe's present politics and its future. The idea of the Republic was born with the political ethics of ancient Greece. The current international crisis obliges Europe to face the mirror of truth: What has become of the European Idea and how fares the European Constitution? It has been a long road from the Greek Politeia to the present lack (...) of values and financial monomania in Europe, who seems to have lost any harmony between the spirit, the soul and the body of her Constitution: the will and values of the people (material constitution), the text of the Lisbon Treaty (formal constitution) and its current political interpretation and action (real constitution), making Europe a two-tier or three-tier club, far from the dream of the founding fathers. Without republican values and virtues, and failing to uphold the European social model, the European Union would devolve into moral, social and democratic bankruptcy. (shrink)

O presente artigo tem o objetivo de apresentar reflexões sobre a possibilidade da educação museal nas escolas públicas municipais de Fortaleza. A Educação Museal é uma prática educativa, democrática, crítica e transformadora, que respeita a diversidade cultural e suas epistemologias. O trabalho tem a justificativa pessoal assentada na trajetória profissional dos autores que promovem práticas educativas em diálogo com outras instituições, em especial, museus, e outros ramos dos saberes, em especial, as artes. É uma pesquisa de natureza qualitativa, que se (...) desenvolve a partir de relatos de experiência em um intercâmbio na França, do programa Professores Sem Fronteiras, além do relato de experiência a partir da obra de Descartes Gadelha, de um projeto contemplado com o edital de Boas Práticas e premiado em Feiras de Ciências, ações promovidas pela Secretaria Municipal de Educação de Fortaleza. É possível considerar que a Educação Museal e as artes como estratégias de ensino na escola podem colaborar para uma formação integral que desenvolvem sujeitos históricos críticos, participativos e transformadores da sociedade. Resumo Este artigo apresenta um referencial pragmatista para compreender o estatuto epistêmico da valoração que é produzida na reflexão acerca das consequências sociais de propostas científicas e tecnológicas. O problema é posto, seguindo-se as considerações de Bertrand Russell sobre o impacto da ciência na sociedade. Russell argumenta que a valoração de arranjos sociais fica fora dos limites do conhecimento, porque valorações não podem ser verdadeiras ou falsas, em sentido correspondencial. Isso leva o pensamento social a um impasse, pois não se (...) pode saber que dado arranjo social seria indesejável ou inadequado. Este texto esboça uma alternativa, a partir dos trabalhos sobre valoração de Clarence Irving Lewis, tomados em continuidade com a teoria da investigação de John Dewey. Esse referencial alternativo assume noções epistêmicas de verdade e justificação, o que permite que valorações possam ser concebidas em contextos de investigação e, assim, como objetos de conhecimento.This article presents a pragmatist framework to understand the epistemic status of valuations produced upon reflection on social consequences of scientific and technological proposals. The problem is set following Bertrand Russell’s considerations on the impact of science on society. Russell argues that valuating social arrangements falls beyond the limits of knowledge, because valuations cannot be true or false in the sense of correspondence. This leads social thought to a deadlock, since one cannot know that a given social arrangement would be undesirable or inadequate. This article sketches an alternative from Clarence Irving Lewis’s works on valuation taken in continuity with John Dewey’s theory of inquiry. This alternative framework assumes epistemic notions of truth and justification, allowing that valuations can be construed in contexts of inquiry and thus as objects of knowledge. (shrink)

Otto Neurath and John Dewey share the understanding that science must have a prominent role in democratic social reform. This is a common aim that brought logical empiricism and pragmatism together in the first half of the 20th century, but there are differences between the two stances. On the one hand, Neurath sees a limitation of scientific knowledge, considering that it cannot determine decisions to be taken in the course of social reform. Such decisions, in the logical empiricist view, are (...) a matter of politics. On the other hand, Dewey sees a continuity among all forms of inquiry and, therefore, the conclusions of valuational inquiry are analogous in their epistemic claims to the conclusions in factual (natural or social inquiry). This paper investigates the divergence and concludes that pragmatist continuity of inquiry is set in a psychological context that disregards a difference in objectivity between factual and valuational inquiry. Este artigo discute a relação entre filosofia da ciência e filosofia da educação a partir do texto de John Dewey Unity of Science as a Social Problem. Dewey propõe que o problema da unidade da ciência seja trabalhado de um ponto de vista não apenas epistemológico, mas também social. Isso é porque nosso entendimento sobre a ciência influencia a educação. A proposta de Dewey é discutida em relação às considerações de filósofos da ciência recentes, como Peter Galison e Paul Feyerabend, (...) de que a ciência não deve ser concebida como um todo unificado. No ensaio “Franz Kafka: uma reavaliação: por ocasião do vigésimo aniversário de sua morte”, Hannah Arendt desenvolve reflexão sobre a construção das personagens kafkianas, a partir das narrativas O processo (1925) e O castelo (1926), na medida em que os heróis kafkianos “desmascaram as estruturas ocultas da sociedade, que frustra as necessidades mais banais e destrói as mais elevadas intenções do homem” (Arendt, 2016, p. 103). Na Literatura de Franz Kafka (1883-1924), verificamos a força germinativa de sua tessitura literária uma (...) vez que nos proporciona leituras sob prismas filosóficos que ampliam nossa compreensão acerca da condição humana, estabelecendo como protagonista o “homem comum”, por meio de uma “história à contrapelo” (Benjamin, 1994). A partir da tessitura literária kafkiana, tal qual um caleidoscópio, o presente artigo tem o propósito de fomentar o debate filosófico em face da múltiplas possibilidades de diálogo e discussão, sob o prisma de Hannah Arendt, por meio de um análise crítico-comparatista com a Literatura de Dostoiévski; sob os olhares estilísticos e filosóficos de Milan Kundera e Deleuze e Guatarri, entre outros pensadores, ao refletirmos acerca do kafkiano e sobre o conceito de “literatura menor” e a “desterritorialização” da língua, bem como destacaremos uma interpretação marxista por meio do pensador Georg Lukács, acerca da sociedade reificada do capitalismo, sobretudo a partir de A Metamorfose. O presente artigo tem o objetivo de ampliar o debate acerca do direito à expressão artística para estudantes da rede pública de ensino como forma de construirmos oportunidades para uma educação emancipadora, as quais sejam inseridas no currículo, haja visto que a escola precisa estar articulada às práticas culturais e políticas da cidade. No que concerne à oportunidade e valorização de expressar-se por meio da Arte, seja a Pintura, a Literatura e outras modalidades, o Museu de Arte da Universidade Federal (...) do Ceará (MAUC) exerceu significativa contribuição para o encontro entre a escola e o patrimônio histórico-cultural da cidade, sobretudo no que tange às coleções do artista Descartes Gadelha, a partir das quais foram engendradas pesquisas e oficinas artísticas que permitiram a sensibilização do olhar para os invisibilizados da cidade, assim como suscitou a crítica para uma desnaturalização das desigualdades sociais de nossa tessitura social. Nesse sentido, pensar a escola e o processo democrático de aprendizado para a construção da “palavramundo” (Freire, 1990) pelos próprios educandos, é fomentar uma reflexão acerca do currículo enquanto um “território em disputa” (Arroyo, 2023), por ser ele o núcleo e o espaço central mais estruturante da função da escola. Por meio da “palavramundo” (Freire, 1990), verificamos um processo de recriação e produção de releituras de conhecimentos de nosso patrimônio histórico-cltural que interagem com experiências trazidas nas narrativas dos nossos estudantes, num processo de apropriação e transformação do qual resultam descobertas sobre a própria condição humana, que ampliam o próprio sentido do processo ensino-aprendizagem. Aristotle’s Eudemian Ethics has always proved to be fertile ground for at times needless textual emendation. I provide a translation and running commentary on Eudemian Ethics II 2 1220a39–b6 in accordance with the MSS text.

This paper compares the claims about our knowledge of the external world presented by Rudolf Carnap, in the book known as the Aufbau, to those of Clarence Irving Lewis, in Mind and the World-Order. This comparison is made in terms of the opposition to Kantian epistemology that both books establish; the Aufbau is regarded as the peak of the logicist tradition and Mind and the World-Order is taken in continuity with pragmatism. It is found that both books present knowledge of (...) the external world as a consequence of a structural organization of human experience. However, there is an important point of divergence: the concept of verification each author adopts is different, such a concept was even a matter of discussion between Lewis and the Vienna Circle. This paper shows this disagreement but also shows how Carnap changed his point of view in the decade after the Aufbau was published, towards a standpoint which is much closer to Lewis’s ideas. In that process, nevertheless, Carnap changed his focus and did not deal with the problem of the external world anymore. This paper also seeks to draw attention to some features of the relation between Carnap and the pragmatist tradition which have only recently started to attract interest. (shrink)

Neste artigo apresentamos as propostas de Otto Neurath para o problema da unidade da ciência. Conhecido integrante do Círculo de Viena, Neurath defende que a ciência deve ser unificada por meio da chamada concepção de mundo científica, uma orientação ou atitude em relação ao mundo e aos problemas que é característica da ciência. Neste artigo apresentamos o caráter social dos projetos de Neurath, como o da Enciclopédia Internacional da Ciência Unificada. Contrastamos a proposta de Neurath com a crítica pós-modernista da (...) abordagem contextualizada dos estudos sobre a ciência. Essa crítica parte de estudos de comunidades científicas e, em geral, apresenta a conclusão de que não há um fator que unifique a ciência. O termo "ciência" denotaria apenas uma coleção de atividades sem características relevantes em comum. A comparação feita mostra que a posição de Neurath é compatível com a abordagem contextualizada, apesar de defender a unidade da ciência. Por fim, avaliamos o aspecto político da proposta de Neurath diante da crítica pós-moderna e notamos que as ideias do Círculo de Viena e da Enciclopédia podem ser valiosas nos dias de hoje. This paper discusses Otto Neurath's proposal for the problem of the unity of science. This author, a well-known member of the Vienna Circle, proposes that science is to be unified by the so-called scientific world-conception, a characteristic orientation or attitude of science towards the world and the problems it deals with. In this paper, emphasis is given to the social aspect of Neurath's projects, as found, for instance, in the International Encyclopedia of Unified Science. It contrasts Neurath's proposal with the post-modernist criticism, developed in the contextualized approach to science studies, that stems from studies of scientific communities and, in general, presents the conclusion that there is no unifying factor for science. The term 'science' would then denote just a collection of activities with no relevant common characteristics. The comparison made shows that Neurath's position is compatible with the contextualized approach, even though he defends the unity of science. Finally, the political aspect of Neurath's proposal is evaluated in the light of the post-modernist criticism, and it is pointed out that the ideas of the Vienna Circle and the Encyclopedia might be valuable nowadays. O presente artigo procura resgatar um dos períodos mais intensos e menos estudados da Guerra Fria no Brasil, quando duas correntes militares antípodas política e ideológicas atuaram na perspectiva de influenciar através de suas entidades de classe um projeto de nação. Entretanto, essa reflexão tem por foco, os militares nacionalistas e de esquerda, oficiais e praças das forças armadas cuja intervenção foi bem sucedida ao final, com a vitória da Tese do Monopólio Estatal do Petróleo e não intervenção brasileira no (...) conflito coreano, embora ao custo de uma repressão sobre centenas de militares, muitos deles presos e torturados e até hoje não anistiados, demonstrando em última instância, a fragilidade da democracia e do Estado Democrático e de Direito no Brasil.The Military and the Cold War in Brazil The present article seeks to recover one of the most intense and least studied period of the Cold War in Brazil, when two military antipodal political and ideological currents acted in the perspective of influencing through its class entities a nation project. However, this reflection is focused on the nationalist and leftist military, officers and squares of the armed forces whose intervention was successful in the end, with the victory of the Thesis of the State Petroleum Monopoly and not Brazilian intervention in the Korean conflict, although at cost of a crackdown on hundreds of soldiers, many of them imprisoned and tortured and still unamused, demonstrating in the last instance the fragility of democracy and the Democratic State and Law in Brazil. Resumen Los Militares y la Guerra Fría en Brasil El presente artículo busca rescatar uno del período más intensos y menos estudiados de la Guerra Fría en Brasil, cuando dos corrientes militares antípodas políticas e ideológicas actuaron en la perspectiva de influenciar a través de sus entidades de clase un proyecto de nación. Sin embargo, esta reflexión tiene por foco, los militares nacionalistas y de izquierda, oficiales y plazas de las fuerzas armadas cuya intervención fue exitosa al final, con la victoria de la Tesis del Monopolio Estatal del Petróleo y no intervención brasileña en el conflicto coreano, aunque al costo de una represión sobre cientos de militares, muchos de ellos presos y torturados y hasta hoy no aniquilados, demostrando en última instancia, la fragilidad de la democracia y del Estado Democrático y de Derecho en Brasil. The present paper draws a contrast between the notions of τὸ παρ’ ἡμᾶς and τὸ ἐφ’ ἡμῖν to the effect that, according to Chrysippus, each has a different role to play and different requirements to meet, the former being especially tailored to suit the exigencies of praise and blame taken as exhortations, the latter those of desert and justice in praising and blaming as well as honoring and punishing.

The aim of this work is to establish a relationship between the notion of supplement, particularly that of “dangerous supplement”, and the passion for botany in Rousseau. For that, I will take as a guide the interpretations of Jacques Derrida, Alain Grosrichard and Alexandra Cook to analyze some passages from Confessions, Reveries and Letters on the botany. I have the hypothesis that botanical activity can be considered as a kind of inoffensive supplement because it evokes an image that combines sex (...) and innocence. (shrink)

We present a new functional interpretation, based on a novel assignment of formulas. In contrast with Gödel’s functional “Dialectica” interpretation, the new interpretation does not care for precise witnesses of existential statements, but only for bounds for them. New principles are supported by our interpretation, including the FAN theorem, weak König’s lemma and the lesser limited principle of omniscience. Conspicuous among these principles are also refutations of some laws of classical logic. Notwithstanding, we end up discussing some applications of the (...) new interpretation to theories of classical arithmetic and analysis. (shrink)

Neurath’s approach to the problem of the unity of science is different from conceptions we may call traditional, to know, those that consider that what unites in one single concept the diverse sciences is the adoption of a method, or those that defend that this is carried through by certain characteristics which can be found in the body of knowledge considered scientific. Neurath’s stance also diverges from the standpoint that there is no unifying factor for science, that is, the view (...) that the different sciences are only classified under such concept because of the historical origin of such activities. Neurath’s proposal is to consider science as an attitude, a posture in relation to the problems of the world, the scientific world-conception. This text presents such approach in connection to the aspect of social transformation that can be found in Neurath’s thought. This is done following a comprehension of the ideas of the Vienna Circle, seeking to understand a continuity among the ideas of the members of such group, especially Neurath and Carnap. The present text aims, as well, at recovering the Neurathian idea that we can use a philosophical approach to science to struggle against the problems of the world. (shrink)

This book highlights some of the most pressing safety, ethical, legal and societal issues related to the diverse contexts in which robotic technologies apply. Focusing on the essential concept of well-being, it addresses topics that are fundamental not only for research, but also for industry and end-users, discussing the challenges in a wide variety of applications, including domestic robots, autonomous manufacturing, personal care robots and drones.

We present a refinement ofthe bounded modified realizability which provides both upper and lower bounds for witnesses. Our interpretation is based on a generalisation of Howard/Bezem's notion of strong majorizability. We show how the bounded modified realizability coincides with our interpretation in the case when least elements exist . The new interpretation, however, permits the extraction of more accurate bounds, and provides an ideal setting for dealing directly with data types whose natural ordering is not well-founded.
